Effective Upon Purchase
By purchasing or accessing any asset (“Asset”) from GMsBox (“Seller,” “we,” “us”), you (“Purchaser,” “you”) agree to be bound by the following Terms of Service (“Terms”). These Terms are presented at checkout, and by completing the transaction you expressly acknowledge, accept, and agree to be governed by them in full.
Your purchase, access to, or download of any Asset constitutes acceptance of these Terms.
1. Grant of License
Upon full payment, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Asset in accordance with these Terms and solely for the uses permitted under the designated license type (Personal Use or Commercial Use).
You acknowledge and agree that:
- You do not own the Asset or any underlying mesh, texture, design, or file.
- All rights, title, and interest remain the exclusive property of GMsBox.
- If purchasing an Asset for another individual, you must use the official Gift function.
- No other transfer of license is permitted.
This license is personal to you and may not be:
- Shared
- Resold
- Traded
- Leaked
- Published online
- Distributed to friends, partners, team members, or any third party
- Used in any way that violates these Terms
2. General Restrictions on Use
You expressly agree not to:
- Leak, redistribute, upload, publish, or otherwise make the Asset available to any third party.
- Resell or trade the Asset, whether individually or bundled, except as part of a completed, finished avatar being sold under a valid commercial-use license.
- Use paid Assets on free avatars or any freely distributed VRChat model.
- Include the Asset in any project that may allow another person to extract it.
- Engage in any ripping, copying, modifying, or pirating of the Asset or any VRChat-related content.
- Participate in, support, or contribute to ripping or piracy communities (e.g., forums, Discord servers, file-sharing groups).
3. Required Credit for Commercial Use
When using the Asset on a for-sale avatar:
- You must credit GMsBox with a direct link to the specific product listing.
4. Accurate Purchase Information
At the time of purchase, you agree that your Discord and VRChat usernames are provided accurately and truthfully. This information may be used for verification of license ownership.
5. License Types
5.1 Personal Use Asset License
A Personal Use license allows the Asset to be used on:
- Your own privately uploaded VRChat models
- Non-commercial projects not distributed or sold
Personal Use Assets may not be used on free models, commercial products, commissions, or any avatar intended for sale.
5.2 Commercial Use Asset License
A Commercial Use license allows:
- Use of the Asset on public avatars
- Use of the Asset as part of a completed avatar you are selling (to an individual client or the general market)
- Use in commissions provided that the customer may not extract, remove, or reuse the Asset independently
The commissioned customer receives the finished model only; they do not receive rights to the standalone Asset.
6. Editing Assets
You are permitted—and encouraged—to edit or customize the Asset.
However, you may not:
- Modify the Asset into political, hateful, extremist, or obscene content (e.g., realistic gore).
- Resell the edited Asset as your own standalone product.
- Sell or distribute any part, mesh, texture, or file extracted from the Asset, except as part of a fully completed avatar project made under a valid commercial license.
7. Anti-Piracy Clause
You agree not to:
- Rip, extract, or duplicate GMsBox assets
- Assist others in doing so
- Join, support, or contribute to communities centered on unauthorized extraction, ripping, or distribution of VRChat assets
Violation of this clause results in immediate termination of your license.
8. License Termination
We reserve the right to immediately revoke your license, remove download access, and terminate all rights to the Asset without notice or refund if we determine that any portion of these Terms has been violated.
Upon termination, you must permanently delete all copies of the Asset and any files derived from it.
Customer support, technical help, product guidance, or any other assistance from GMsBox (including through Discord channels, direct messages, troubleshooting, updates, or modifications) is reserved exclusively for Purchasers who have abided by these Terms.
If at any point you are found to have broken these Terms of Service, we will no longer be providing assistance.
We reserve the right, at our sole discretion, to refuse, limit, or permanently deny any support.
9. Refund & Chargeback Policy
All payments are final and non-refundable.
Because the Asset is digital content delivered instantly, you hereby waive all rights to refunds, returns, reversals, and chargebacks once access or download has been granted.
Attempted chargebacks constitute a breach of these Terms and may result in loss of all licenses and access.
10. Checkout Agreement
By completing checkout, you:
- Confirm that you have read, understood, and agreed to these Terms
- Consent to being bound by them
- Agree that your purchase cannot be completed without accepting these Terms
- Acknowledge that these Terms constitute a binding contract upon purchase
11. Acknowledgment
Your download, access, or continued use of the Asset confirms your ongoing acceptance of these Terms.
DMCA Enforcement
All Asset files,and associated content are protected under U.S. and international copyright law. Unauthorized ripping, copying, distribution, or re-uploading of any GMsBox content will result in immediate DMCA takedown action against all platforms hosting the infringing material. We may also pursue additional legal remedies, including but not limited to financial damages, removal of VRChat accounts from platform, and revocation of all purchased licenses.
